No-one wants to be in debt. Most people would prefer to pay all of their bills on time and with ease, just as they would prefer to have the money set aside instead of taking out loans or defaulting on the mortgage. However, when money comes into play there are always going to be those in debt, who have either fallen behind in payments or not made any payments at all. In these sorts of situations there are various ways in which companies might try to retrieve this money through debt collection.
Companies can handle debts in many ways and in a majority of cases they are resolved simply, usually via telephone or letters so that any ugly business involving law enforcement can be avoided. This means that the company will hire a debt collection company to take the matter up, sending the person who owes the debt letters and phoning them in an attempt to solve the dispute. However, there are various ways in which this might not work. Usually it will be because the debtor does not have the funds to pay for it or they argue that the debt is not owed. If however the debtor cannot be found, identified or the debt itself has proven to be many years old, further problems could arise.
However if the person is known and owes a debt then the debt collectors may also pay the person a visit, with some willing to visit any property, whether it is an a commercial setting or if it is a residential property. Legal action will usually be pursued if the payment is yet to be made following those steps. This is where the courts will take action.
As it is a money issue, the matter will likely go through the County Court. This is for any debts that would be above £5,000. Debts below this amount would be dealt with through Small Claims Procedure. It will be up to the debtors to make sure they then make payments. Once this has passed then the law will begin to take further action, resulting in harsher penalties. Many debtors will pay the debt once the court hearings have taken place, but this clearly depends on the situation. If the debtor does not have the money then matters will take a different course.
